☆ Opinion: The basic problem with putting Trump on trial

In this week’s mammoth New York trial of former President Donald Trump on charges of falsifying business records in connection to hush money paid to an adult film star, the yawning gap between “Us” and “Them” is along partisan lines. After all, making hush money payments, as Trump is alleged to have done with former adult film actress Stormy Daniels, isn’t illegal. For decades, Trump has been a fixture on our airwaves, social media sites and political coverage. But they didn’t, and now many are feeling a rally-round-the-flag effect in what is likely the first and potentially only Trump criminal case that’s going to trial before Election Day. Bragg’s decision to bring this case, with its attenuated connection to an actual crime, can’t be taken out of its political context.

Trump has reached for apocalyptic rhetoric, calling for his supporters to protest at the Florida courthouse when he is arraigned on Tuesday. The threats of violence reflect an authoritarian impulse completely at odds with the alleged principles of the Republican Party and the conservative movement. Here’s the key difference: Trump was not charged for having the classified documents but for willfully trying to hide the documents after the feds enquired. When facts and reason no longer apply, desperate individuals resort to threats of violence.

Manhattan District Attorney Alvin Bragg ’s looming indictment of Donald Trump should be judged on its legal merits. I agree with attorney-turned-columnist David French—if the underlying theory of the case is untested and risky, “then don’t file the charge”—and former federal prosecutor Andrew McCarthy—“this is a really dumb case.”But if the charge is filed and the former president doesn’t plead guilty, the case will be heard. With Mr. Trump running again, there will be political fallout, especially if more indictments follow, such as for mishandling classified documents. With Mr. Trump, there always seems to be one more scandal around the corner.

Social media users have claimed that because stars are not routinely visible in photographs taken from spacecraft, space itself is a hoax. One clip that circulated online showed images taken from the Artemis I Orion shuttle with no stars visible. However, the daytime sky on Earth is only blue due to “scattering of light in the Earth’s atmosphere,” Smethurst said. In the case of the Artemis I mission, the settings would be adjusted to focus on the Earth, Moon and the spacecraft itself. This can be tested at home, McCarthy told Reuters, by trying to take a photo of a full moon and stars at the same time.

The Oath Keepers is an anti-government militia whose membership includes current and former U.S. military and law enforcement personnel. As lawmakers met on Jan. 6 to certify Biden's election victory, some Oath Keepers stormed into the Capitol building, clad in paramilitary gear. The Justice Department's last attempt to prosecute a seditious conspiracy case was in 2010, when it charged members of a Michigan militia called the Hutaree. Prosecutors are expected to use video clips from the Jan. 6 attack, text messages and audio recordings of some of the Oath Keepers defendants. Four other Oath Keepers members charged with seditious conspiracy are due to go on trial on Nov. 29.
